User Agreement

The terms that apply to your use of Red Union Support Hub websites, services and memberships.

1. About these terms

  1. This User Agreement ("Terms") governs your use of the websites, services, and memberships provided by Red Union Support Hub ("RUSH"), including all websites hosted at redunion.com.au and its subdomains.
  2. RUSH is the service entity that administers subscriptions, provides workplace support services, and coordinates membership of affiliated professional and industrial associations (listed and linked in the side-bar) on behalf of its subscribers.
  3. By using any RUSH website, subscribing to RUSH, or accessing RUSH services, you agree to these Terms.
  4. RUSH reserves the right to update these Terms from time to time. Updates take effect upon publication on this page, and continued use of RUSH services constitutes acceptance of the updated Terms.

2. Signup Terms – (For Subscribers)

Throughout our platforms, "subscriber", "member", and "membership" are used interchangeably. When you subscribe to RUSH, you also "join" or are "joining" as a member of affiliated association(s) and agree to these signup terms.

By signing-up as an employee seeking membership of a Red Union professional association, you understand and agree to the following:

  1. Subscription is to RUSH – Payments will be treated as a subscription to, and will be receipted by, Red Union Support Hub as your appointed agent ("the Agent").
  2. Subscribers are joined to affiliated associations – The Agent uses part of your subscription fee, as agreed with the relevant association(s), to apply on your behalf for membership to those association(s).
  3. The affiliated associations' constitutions – By subscribing to the Agent, you are also joining one member-based company limited by guarantee ("professional association") as a member and one Victorian registered incorporated society ("industrial association") that provide members with brand licensing, advocacy, and services. The associations you are joined to depends on your occupation and state or territory of employment. You agree to abide by the constitution, by-laws, policies, and procedures of each association you are joined to that are available at your association's "structure" page.
  4. Appointment of authorised representatives and agents – By joining, you authorise a third-party nominated representative, separately or jointly agreed to by the association(s) or the Agent, or a representative of the association(s), the association itself, or the Agent or its nominee, or jointly as above with the Agent or its nominees, to act as your bargaining agent, industrial representative, or spokesperson. You authorise them to represent you in any industrial matter or dispute. Such an appointment applies until withdrawn by you in writing.
  5. Resignation from other bodies – You authorise the Agent to act for you with respect to the relevant employee and/or professional association(s) nominated by you, including, if requested and authorised by you, to advise your resignation from any other professional association(s) and/or union(s) of which you may currently be a member.
  6. Limited liability for members – In the event that any company limited by guarantee is wound up, of which you are a member, your liability as a member is limited to no more than one (1) dollar.
  7. Recurring payments – RUSH will establish an automatically renewing subscription payment at the interval selected by you during your sign-up, or as modified from time to time.
  8. Accuracy of information – You declare that the details provided in your application are, to the best of your knowledge, true and accurate.
  9. Additional terms – For the avoidance of doubt, you agree to the rest of this User Agreement and the related terms below. 

Related terms that apply to subscribers

The following terms form part of your overall agreement with RUSH and the relevant associations. They apply to specific features or products of our platform. You can read them alongside these Terms:

  1. Industrial Terms of Service — governs the provision of industrial support when you submit a Member Support Form, including how and when we may escalate your matter to legal practitioners. Available at http://www.redunion.com.au/industrial-terms.
  2. Loyalty Program Terms and Conditions — governs the Red Union Loyalty Program and any associated promotions. Available at redunion.com.au/loyaltyterms.

  4. Pricing and Refunds Policy – See clause 7 of this User Agreement. 
  5. Association constitutions and by-laws — accessible via the Structure page of the relevant association's website (see clause 3 below), or through your Member Dashboard.

Other agreements

If you have other services, like Red Academy or Red Tax, these may be governed by a separate user agreement with those entities. 

Certain services offered through or alongside RUSH — including Red Tax, Red Academy, and any legal practitioners engaged on your behalf — may have their own terms of services or user agreements. RUSH is not responsible for the terms imposed by independent third-party service providers. Please notify the Hotline of any issues that may arise with a third-party service provider. 

3. Associations and structure

RUSH supports a network of professional and industrial associations across Australia. When you subscribe to RUSH, you are joined to the association(s) relevant to your occupation and location. Each subscriber is joined to both a professional association (an Australian public company limited by guarantee, or "Ltd") and an industrial association (an incorporated association, or "Inc").

Each professional association (Ltd) is a company limited by guarantee registered with ASIC. Each industrial association (Inc) is a registered organisation or incorporated association whose principal purpose is to protect and promote the interests of members in matters concerning their employment or professional engagement.

4. Professional indemnity protections and insurances

  1. Red Union Workers' Mutual – Red Union Workers' Mutual ("the Mutual") is a separate entity to Red Union Support Hub. Neither Red Union Support Hub nor any of the associations are insurance providers. Where insurance or indemnity protection is available to members, it is arranged via an external insurers or the Mutual.
  2. Availability – Insurance or indemnity protection is available to members of certain associations as part of their membership benefits. The availability, type, and scope of cover varies by association and is subject to the relevant policy terms. Reinsured indemnity is provided via a Lloyd's of London syndicate insurer to nurses and medical professionals. Insurance or indemnity protection is not currently available to members of SOPAA, IWUA, nor Medical Practitioners. 
  3. Professional indemnity for teachers. For members of the teaching associations (TPAA, TPAQ, TPAN, TPAV, TPAWA, TPASA), professional indemnity is discretionary protection under the TPAA Protection Wording, and is not a contract of insurance. No insurer is involved. If you have a complaint about a claim decision that we cannot resolve with you, you can take it to the Australian Financial Complaints Authority (AFCA).
  4. Not financial advice. Nothing in these Terms or on any RUSH website constitutes financial product advice. You should consider your own circumstances and, if necessary, seek independent advice before relying on any insurance or indemnity arrangement.
  5. Policy information. Full details of available insurance and indemnity arrangements, including relevant policy documents, are available on the insurance or indemnity page of the relevant association's website or upon request from RUSH, you can use our below "find your policy" tool.

5. Workplace protection, industrial support, and legal protection

  1. Nature of services – RUSH, the associations, their staff, and their paid agents provide workplace protection and industrial support services. These services are strictly industrial in nature and do not constitute legal services.
  2. Not legal practitioners nor practices – Neither RUSH, nor any professional association, nor any industrial association affiliated with RUSH is an incorporated legal practice. Case managers and industrial advocates employed or engaged by RUSH or the associations are industrial agents and advocates, not legal practitioners.
  3. Legal Protection – All references to "legal protection" (or similar wording) refers to the engagement of a legal practice funded by RUSH to act on behalf of the subscriber for their workplace related matter if appropriate, as determined on a case-by-case basis by the RUSH and/or the affiliated association.
  4. Level of Services – The level of services provided shall be at the discretion of the Association concerned and RUSH, taking into account the nature and complexity of the Industrial Matter, available resources, the timing of the event compared to subscription start date, and the conduct of the Member.
  5. Industrial Terms of Service. Where a member submits a Member Support Form to request industrial support, the provision of that support is governed by the Industrial Terms of Service. By submitting a Member Support Form, you agree to be bound by those terms.

For clarity — RUSH's industrial team provides contactable and reliable workplace support. If your matter is referred to an independent legal practice (with or without RUSH's funding), you would be entering a separate agreement with that practice.

6. Website use & intellectual property

  1. Contact – By using any RUSH (or affiliated association's) website, purchasing a membership, or completing an online survey, you permit RUSH and/or the relevant association or its service providers to contact you by phone or email about products, promotions, or other matters that relate to you as a user of the website. See our Privacy Policy for further information.
  2. Copyright & IP – All text and customised graphics on RUSH and its affiliated associations' websites, including all logos and branding, are provided to RUSH or the relevant association under agreement. Under no circumstances is any content to be reproduced without prior written consent of the copyright holder or their licenced delegate.
  3. Website hosting – The domain host of redunion.com.au and its various subdomains is RUSH. The content published on each association's subdomain is provided by the association's own staff or executive or on behalf of that association by RUSH.

7. Pricing, refunds, and cancellations

  1. Pricing – All prices displayed on RUSH and its affiliated association's websites are in Australian Dollars and are GST inclusive.
  2. Subscription term – All subscriptions to RUSH are for a 12-month contract term, commencing on the member's join date and renewing automatically on each anniversary thereafter.
  3. Cooling-off period – A 7-day cooling-off period applies upon each new subscription event (not renewals), entitling members to a full refund provided no membership services or benefits have been accessed following the renewal date.
  4. Cancellation process – All enquiries regarding refunds and cancellations must be lodged using the Manage your Membership Form available on your Member Dashboard. Each refund is individually assessed.
  5. Errors – If you make an error when completing a Membership Application, contact us immediately at hotline@redunion.com.au, live-chat, or 1300 252 777 so it can be rectified.
  6. Duplicate users - Users cannot create a new account in order to obtain a greater benefit than if they continued on their current membership or reactivated a previous membership and we reserve the right to modify or remove  benefits or credits for any dishonesty in the creation of new subscriptions.
  7. Consumer law – These terms do not, and can not, limit or exclude any rights under Australian Consumer Law.

8. Privacy

  1. RUSH collects, stores, and uses personal information in accordance with the Australian Privacy Principles and relevant legislation.

  2. All information collected is stored securely by RUSH on behalf of the associations.

  3. All phone calls with the Hotline or a Case Manager are recorded for quality and training purposes. These recordings are treated confidentially.

9. General provisions

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.

No waiver

If we don't enforce a provision on one occasion, that doesn't mean we've waived the right to enforce it later.

Governing law

These Terms are governed by the laws of Queensland, Australia. Any disputes are subject to the jurisdiction of the courts of Queensland, unless the matter relates specifically to an association registered in another state or territory, in which case the laws of that state or territory apply.

Assignment

You can't transfer or assign your membership benefits or any rights or obligations under these Terms without RUSH's prior written consent.

Notices

Any notice under these Terms may be in writing and delivered by email to the last known address of the recipient, or via telephone provided the telephone call is recorded. 

No political affiliation

No membership fees are used to support any political party.
